The Commission may hold a closed session, as authorized by Government Code §11126(e), to confer with and receive advice from its legal counsel regarding potential litigation, and as authorized by Government Code §11126(a).

The Executive Officer will report on various matters addressed since the previous Commission meeting.

6.  Commission Member Reports

This is an opportunity for members to disclose any meetings or conversations related to Commission business since the previous Commission meeting.

7.  Public Testimony

Although no formal Commission action will be taken, the Commission offers an opportunity to the public to address the Commission on items of interest that are within the Commission’s jurisdiction, but that do not specifically appear on the agenda.

8. Action Item: Water Storage Investment Program (WSIP) Maximum Conditional Eligibility Determinations – Rank 2

The Commission will review staff recommended maximum conditional eligibility amounts and determine a maximum conditional eligibility amount for each project in rank 2, pursuant to section 6011 of the WSIP regulations. The maximum conditional eligibility amount is a “not to exceed” amount of potential funding, contingent upon the applicant meeting the conditions of section 6013 of the WSIP regulations.

9. Action Item: WSIP Maximum Conditional Eligibility Determinations – Rank 3

The Commission will determine a maximum conditional eligibility amount for each project in rank 3, pursuant to section 6011 of the WSIP regulations. Projects in rank 3 may only be considered for funding if all projects in rank 2 are funded to the full amount of the projects’ requests, pursuant to section 6011(h)(2).

10. Action Item: Consideration of WSIP Early Funding Requests

Section 6010 of the WSIP regulations describes the process for awarding early funding for environmental documentation and permits, pursuant to Water Code section 79755(c). Per section 6010(c)(6) of the WSIP regulations, a project may receive early funding only if the Commission has assigned a maximum conditional eligibility amount to the project. Four applications included requests for early funding. The Commission will consider each request.

Members of the public shall be provided an opportunity to address the California Water Commission on any agenda item except closed session items. Comments during the public comment period shall be limited to matters within the Commission’s jurisdiction. Reasonable time limits may be established for public comments (Government Code Section 11125.7), and the Commission has established a three- minute limit per comment, per agenda item.

Agenda items may be heard in any order at the discretion of the Commission.

Written comments regarding specific items on this agenda will be provided to the Commissioners in hard copy as part of their meeting packets if they are received by 1:00 p.m. on Friday, July 20, 2018.Staff will make every effort to provide comments received after this deadline electronically, but we cannot make any guarantees.
