1. APPROVAL OF MINUTES OF THE REGULAR PLANNING COMMISSION MEETING ON SEPTEMBER 1, 2009.


 PUBLIC HEARINGS

 DISCLOSURE OF EX PARTE COMMUNICATIONS:
Prior to a project hearing Planning Commission Members must disclose any communications they have had on any
quasi-judicial agenda items. This includes, but is not limited to, Tentative Subdivision Maps, Parcel Maps,
Variances, Conditional Use Permits, and Planned Development Permits. This does not disqualify the Planning
Commission Member from participating and voting on the matter, but gives the public and applicant an opportunity
to comment on the ex parte communication.

(For each of the following items, the public will be given an opportunity to speak. After a staff report, the Chair will open the public
hearing and invite the applicant or applicant’s representative to make any comments. Members of the public will be invited to provide
testimony to the Commission following the applicant. Speakers should state their name and address for the record and can address the
Commission for three minutes. After all public comments have been received, the public hearing will be closed, and the Commission
will discuss the item and take appropriate action(s).)



2.  RECONSIDERATION OF PLN 2099-0912, AMENDMENT OF PROJECT CONDITION #7 OF TENTATIVE TRACT MAP 2003-0029 ON ENCINO RD.

Project Title:

Reconsideration of PLN 2099-0912 (Amendment of Project Condition #7)

Project Location:

Encino Avenue between Atajo Avenue and Chauplin Road
APN 031-091-005, 006, 008, 009, (APN 031-091-009 is 2 separate lots) and
031-092-016 (San Luis Obispo County) [6 Colony Lots total]

Project Description:

This is a request for reconsideration to amend Condition #7 of Tentative Tract Map 2003-
0029, imposed by the Planning Commission on November 21, 2006, requiring the tree
mitigation fee payment of $18,233. The original project was a Tentative Tract Map that
approved the reorganization of the lot lines for six (6) historic Colony lots in order to
provide for an improved lotting pattern that would preserve more oak trees, improve access
and reduce some of the grading anticipated with the development of individual singlefamily
lots.

Proposed Environmental Determination:

A Mitigated Negative Declaration was certified by the City Council in 2003. The
project is substantially the same as the original Tentative Tract Map that was the
subject of the CEQA Findings. The Tree Mitigation Fee was not imposed by the
City Council as a project mitigation measure.
