Public hearing and Commission action on a proposed administrative order and agreement through which the Rosalena Owners’ Association and members of the association agree to address past non-compliance with CDP 6-85-482 by complying with the terms and conditions of the CDP, including by, among other things, (a) ceasing any unpermitted activity; (b) constructing a public blufftop trail within the public trail easement that extends across 24 contiguous properties in the Rosalena residential community, in the vicinity of Navigator Circle in the City of Carlsbad; and (c) refraining from any activity that would limit the public’s use of the public trail easement. 8.2. Consent Administrative Civil Penalty No. CCC-18-AP-03 (Rosalena Owners’ Association, Carlsbad, San Diego Co.)

Public hearing and Commission action on a proposed penalty assessment and agreement through which the Rosalena Owners’ Association and members of the association agree to pay a monetary penalty and undertake public access projects in lieu of paying additional penalties, collectively resolving monetary liabilities under (a) Public Resources Code (“PRC”) section 30821 and (b) PRC sections 30820 and 30822, for non-compliance with public access requirements of CDP 6-85-482, at the Rosalena residential community in the vicinity of Navigator Circle, Carlsbad. Dredged material will be deposited in surf zone at Cell 1 of Pierpont Groin Field, and in surf zone or nearshore waters of mouth of Santa Clara River.
