ANNOUNCEMENT OF RESULTS FROM EXECUTIVE SESSION.

There was no Executive Session, therefore, no report.

DEPARTMENT 2004 REPORT ON THE CALIFORNIA RECREATIONAL FISHERIES SURVEY (CRFS).

Received Departmentís report; received public testimony.

13.

BASED ON THE 2004 CRFS DATA REPORT, THE COMMISSION WILL DISCUSS POSSIBLE IN-SEASON ADJUSTMENTS FOR THE NEARSHORE FISHERY TO ALLOW FOR MORE ANGLING OPPORTUNITIES IN 2005.

Received Departmentís recommendations for no action; received public testimony. Commission recommended that the Department utilize its authority to reopen the nearshore fishery as it was regulated in 2004 as soon as possible, and report back to the Commission regarding its action at the Commissionís May meeting.

RECEIPT OF PUBLIC TESTIMONY ON PROPOSED CHANGES TO SECTION 7.50(b)(91.1), TITLE 14, CCR, RE: KLAMATH-TRINITY RIVER SALMON REGULATIONS. (Note: Adoption will be considered at the May 5, 2005, meeting in Sacramento.)

Received Departmentís proposal; received public testimony. Commission recommended no change to last yearís in-river allocation of 15 percent.

RECEIPT OF PUBLIC TESTIMONY ON PROPOSED CHANGES TO SECTION 27.80, TITLE 14, CCR, RE: OCEAN SALMON FISHING REGULATIONS. (Note: Adoption will be considered at the May 5, 2005, meeting in Sacramento.)

REQUEST OF CENTRAL COAST SALMON ENHANCEMENT, INC., SAN LUIS OBISPO COUNTY , FOR COMMISSION SUPPORT OF ITS ROCKFISH ENHANCEMENT PROGRAM REQUEST BEFORE THE CENTRAL COAST REGIONAL WATER QUALITY CONTROL BOARD AS PART OF ITS MITIGATION REQUIREMENTS FOR PG&E'S DIABLO CANYON NUCLEAR POWER PLANT.

REQUEST OF FRANK BERTONI, FORT BRAGG, AND DAN YOAKUM, ALBION, FOR COMMISSION AUTHORIZATION TO ISSUE EXPERIMENTAL MARKET SQUID VESSEL PERMITS PURSUANT TO SECTION 149.3, TITLE 14, CCR.

Received Mr. Bertoniís and Mr. Yoakumís request; received Departmentís recommendations; received public testimony. Commission approved the requests and directed the Department to issue the experimental fishery permits as soon as the regulations become effective.

RECEIPT OF PUBLIC COMMENTS ON THE COMMERCIAL DUNGENESS CRAB FISHERY AND POSSIBLE LEGISLATION.

Received Departmentís recommendations; received public testimony. Commission indicated that it would continue to work with Assemblymember Leno, the Department, and the fishermen regarding management of the Dungeness crab fishery.

Commissioners unanimously approved adding this item to the agenda.

Received Departmentís request; no public testimony. Commission authorized staff to publish notice of intent to consider amending Section 7.00(f), Title 14, CCR, regarding possible closure of the upper Ventura River and associated tributaries if adult steelhead passage is verified OVER Robles Diversion Dam.

DEPARTMENT REQUEST TO REMOVE THE SPECIES DESIGNATION FOR THE 2005 CALIFORNIA DUCK STAMP.

Commissioners unanimously approved adding this item to the agenda.

Received Departmentís request; no public testimony. Commission approved removing the species designation for the 2005 California Duck Stamp, to allow for an artist to use any appropriate painting for the competition that has not been marketed.
