  The Commission may hold a closed session, as authorized by Government Code §11126(e), to confer with and receive advice from its legal counsel regarding potential litigation, and as authorized by Government Code §11126(a).

5. Executive Officer’s Report
  The Executive Officer will report on various matters addressed since the previous Commission meeting.
6. Commission Member Reports
  This is an opportunity for members to disclose any meetings or conversations related to Commission business since the previous Commission meeting.
7. Public Testimony
  Although no formal Commission action will be taken, the Commission offers an opportunity to the public to address the Commission on items of interest that are within the Commission’s jurisdiction, but that do not specifically appear on the agenda.
8. Action Item: Rancho California Water District’s Vail Dam
The 2016 Water Infrastructure Improvements for the Nation (WIIN) Act provides federal funding for water infrastructure. Section 4007, related to water storage, requires the Commission to determine that California storage projects seeking funding from the WIIN Act are consistent with Proposition 1, the California Water Quality, Supply, and Infrastructure Improvement Act, approved November 4, 2014. The Rancho California Water District will present information to the Commission about how its Vail Dam replacement project is consistent with Proposition 1. The Commission may determine the project is consistent with Proposition 1, or may take another action as the Commission determines, in its discretion.

9. Action Item: Documenting Process for WIIN Act Consistency with Proposition 1
The Commission will consider whether to document a process for determining the consistency with Proposition 1 for projects that seek federal funding under the 2016 WIIN Act.

10. Action Item: Approval of 2018 State Water Project Annual Review
Commission staff will present the final draft of the 2018 Annual Review of the Construction and Operation of the State Water Project.

11. Water/Energy Nexus: How Water Agencies Account for Greenhouse Gas (GHGs) Emissions
  A panel of representatives from water agencies will brief the Commission on how their organizations measure, track, and account for GHG emissions
12. Governor Newsom’s Water Resilience Portfolio Initiative: Listening Session Part 1
  This item provides public input into the development of the Governor’s strategy for building a climate-resilient water system and ensuring healthy waterways. A panel of water management experts will offer their perspectives on what a “climate-resilient water portfolio” for California could look like, models for resiliency, and what elements California should focus on to achieve that resiliency. The Commission will take public comment on these ideas and discuss how they align with the principles expressed in Executive Order N-10-19. The Commission may direct staff to organize a second listening session in August to pursue selected topics raised during the discussion.

Comments during the public comment period shall be limited to matters within the Commission’s jurisdiction. Reasonable time limits may be established for public comments (Government Code Section 11125.7), and the Commission has established a three minute limit per comment.
